Terms of Service
Effective Date: January 1, 2026
Overview
By booking a session or purchasing products from McKenzie Studio, you agree to these Terms of Service. These terms govern the relationship between you ("Client" or "Customer") and McKenzie Studio ("Studio").
Photography Services
Booking & Payment: A non-refundable deposit is required to secure your session date. The remaining balance is due on or before the day of the shoot unless otherwise agreed in writing.
Cancellations: Cancellations made less than 48 hours before the scheduled session may forfeit the deposit.
Weather: In the event of adverse weather, we reserve the right to reschedule the session to a mutually agreed-upon date without penalty.
Travel Fees: Travel fees apply for locations outside of our standard operating zones (San Diego). Fees for Orange County and Los Angeles are specified in your booking agreement.
Intellectual Property & Usage Rights
Copyright: McKenzie Studio retains the worldwide copyright to all images and footage created.
Client Usage (Individual): For individual bookings, you are granted a personal, non-exclusive license to use the images for personal social media and printing. You may not sell or license the images to third parties.
Client Usage (Brand/Commercial): For commercial bookings, usage rights are defined in your specific invoice or contract. Unless explicitly transferred, raw files remain the property of McKenzie Studio.
Studio Usage: We reserve the right to use any images created for our portfolio, website, and marketing materials.
Digital Products (Presets)
License: When you purchase a preset pack, you receive a personal, non-transferable license to use the presets for your own editing. Redistribution, resale, or sharing of the preset files is strictly prohibited.
Refunds: Due to the nature of digital downloads, all sales of preset packs are final and non-refundable.
Physical Products (Prints & Gear)
Production: Our prints and merchandise are made-to-order by trusted third-party partners (e.g., Printful, Printique).
Shipping: Shipping times are estimates and not guarantees. We are not responsible for delays caused by carriers.
Returns: Because items are custom-made, we do not accept returns for buyer's remorse. If an item arrives damaged or with a manufacturing defect, please contact us within 7 days of delivery for a replacement.
Liability
Indemnification: You agree to hold McKenzie Studio harmless from any liability, damage, or loss resulting from your use of our services or products.
Limit of Liability: In the unlikely event of data loss (e.g., corrupted memory cards) or equipment failure, our liability is limited to a full refund of the session fee. We are not liable for re-shoot costs or consequential damages.
